Coverage of the Lemon Law in Ohio

The Ohio Lemon Law rules cover "motor vehicles," which can include cars, sport utility vehicles, pick-up trucks, vans, motorcycles, all-terrain vehicles, motor homes and recreational vehicles. In addition, Ohio lemon law rules state that the vehicle must be used for non-commercial purposes (i.e. a vehicle used by a business may not qualify under the lemon law).

In order to bring a claim under the law for a lemon in Ohio, you must be a "consumer," meaning that you either purchased the motor vehicle (for purposes other than resale) or leased the motor vehicle. You could also be a person to whom the vehicle was transferred during the duration of the express (written) warranty or any other person who is entitled by the terms of the warranty to enforce it.

The Ohio Lemon Law rules applied to all "nonconformities" in a motor vehicle, which means a defect or condition which substantially impairs the use, value or safety of the vehicle to the consumer and which does not conform to the express warranty. The non-conformity must also have been reported to the manufacturer within the first year from the date of original delivery or during the first 18,000 miles of operation, whichever comes first. You case can be strengthened if during that time frame, you can meet any of the following Ohio lemon Law presumptions:
Substantially the same nonconformity has been subject to repair three or more times and either continues to exist or recurs;
The vehicle is out of service by reason of repair for a cumulative total of thirty or more calendar days;
There have been eight or more attempts to repair any nonconformity; or
There has been at least one attempt to repair a nonconformity that results in a condition that is likely to cause death or serious bodily injury if the vehicle is driven, and the nonconformity either continues to exist or recurs.
