How Does the Lemon Law Process Work?
Once you know your rights under the Lemon Law and you have decided to hire us to pursue your lemon law case, we first contact the manufacturer by letter. We provide them with copies of all of your repair records and a detailed explanation of the applicable law. In many instances, this is all that is necessary to initiate settlement negotiations.
You may feel like no one cares about your vehicle problems. If you have been trying to resolve the situation on your own, chances are you have been shuffled back to the dealer for more repairs or they are just trying to placate you with false promises that they will get it right. However, once you have an experienced legal team like Luxenburg & Levin to guide you through the lemon law process, the manufacturers look at your case very differently. They now understand you are serious (if they did not get it before) and they know that litigation is a very real possibility.
Unfortunately, not all disputes can be settled out of court. If the manufacturer does not make a reasonable offer in this pre-litigation phase, the next step in most instances is to pursue your case through an informal dispute resolution procedure. If your case has still not been resolved after IDR, a lawsuit will be filed. Sometimes, this is the step that is necessary to get a reasonable offer. Not only have you showed the manufacturer that you really are serious, but the file is now in the hands of their attorney. Often times, attorneys make recommendations to their clients to resolve cases based upon issues that the manufacturers may never have considered.
Especially at this phase of the lemon law process, having an experienced legal team on your side can make all the difference. At Luxenburg & Levin, we have over 16 years of combined experience in consumer litigation. We have dealt with every conceivable manufacturer and every conceivable issue that arises in these cases. We have handled lemon law cases from the pre-litigation phase through trials and appeals, all the way to the Ohio Supreme Court. Together, we have helped well over 2,500 consumers throughout Ohio. The manufacturers and their attorneys know us and respect us. Would you rather trust something so important to you to an experienced legal team or a first year associate who is cutting his teeth on your case?
